We operate the website london-boutique.uk (the "Website"). On it, we sell women's clothing, footwear and fashion accessories to consumers (the "Products").
By browsing the Website or placing an order, you accept these Terms and Conditions of Use and Sale (the "Terms"). The version that applies is the one in force when you place your order. If you do not accept these Terms, please do not use the Website.
We may amend these Terms at any time. The version that applies is the one in force when you browse the Website or place your order.
1. Definitions
- Customer: any individual aged 18 or over who places an order on the Website for personal use.
- Order: any order for Products placed through the Website.
- Account: an optional account the Customer may create to place orders and track purchases.
- Basket: the area where the Customer's selected Products are held before the order is confirmed.
2. Purpose
These Terms set out the conditions for accessing and using the Website. They also set out the rights and obligations of both parties when Products are sold online.
3. Eligibility
To place an order, the Customer confirms that they are aged 18 or over and have the legal capacity to enter into a contract. These Terms apply only to consumers buying for personal purposes.
4. Accessing the Website and creating an Account
Anyone may access and browse the Website. You do not need an Account to place an order. You can check out as a guest, or create an Account to make it easier to track future orders.
If you create an Account, you agree to:
- provide accurate and up-to-date information;
- keep your login details confidential, as you are responsible for them;
- tell us immediately at info@london-boutique.uk if you suspect anyone has used your Account without permission.
You can ask us to delete your Account at any time by emailing the same address.
5. Product descriptions
We take great care to present our Products accurately, using descriptions and photographs that reflect their features, such as material, size and colour. Slight variations may occur, for example in colour depending on your screen settings. Products will always match their description in all material respects.
We may change, update or withdraw any Product at any time, subject to availability.
6. Placing an order
To place an order, select the Products you want and add them to your Basket. Then proceed to checkout and enter your delivery and billing details.
Once you confirm your order, you will receive an email with your order details and an order number. Your order is only accepted once our payment provider has authorised your payment.
We may refuse or cancel an order if:
- the order appears unusual;
- we suspect fraud;
- the Product ordered is out of stock.
If this happens, we will let you know by email and refund you in full at no cost to you.
7. Prices
Prices on the Website are shown in pounds sterling (GBP) and include VAT. Delivery is free on all orders, with no minimum spend, unless the Website states otherwise.
We may change our prices at any time. Changes do not affect orders that have already been confirmed.
8. Payment
You can pay by card (Visa, Mastercard, Maestro, American Express), PayPal, Apple Pay, Google Pay or Shop Pay. Online payments are secured by SSL encryption.
By confirming payment, you confirm that you are the authorised holder of the payment method used. You also authorise us to charge the full amount of the order.
9. Delivery
We work directly with our suppliers to offer competitive prices. Orders are processed within 1 to 3 working days and then dispatched through our delivery partners. Delivery takes 8 to 12 working days on average. Delivery may take longer during busy periods.
We currently deliver to the United Kingdom only.
You are responsible for giving us an accurate delivery address. If an order has to be re-sent because of an address error on your part, the cost of re-sending it is your responsibility.
If your delivery is delayed or incorrect for reasons that are not your fault, we will email you as soon as we become aware of it and offer a suitable solution.
10. Cancellation and returns
10.1 Your statutory right to cancel
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within fourteen (14) days of receiving it. You do not need to give a reason. After telling us that you are cancelling, you have a further fourteen (14) days to send the goods back.
10.2 Extended returns period
In addition to your statutory rights, we allow you up to thirty (30) days from receiving your order to return any item that is not right for you.
10.3 How to return an item
To return an item, email us at info@london-boutique.uk with:
- your order number;
- the reason for the return;
- a photo, if the item is faulty;
- your name and address.
We will review your request and send you the correct returns address. Please do not send your parcel to the sender address shown on the original package.
You are responsible for the cost of returning items, unless the item is faulty or we made a mistake.
We will refund you within fourteen (14) days of receiving the returned item, or of you providing evidence that you have sent it back, whichever is sooner. Refunds are made to the original payment method.
You may handle an item as you would in a shop to check its nature, characteristics and fit. If an item has been worn, washed or damaged beyond this, we may reduce your refund to reflect the loss in value. Please return items with their original tags and packaging where possible.
10.4 Items that cannot be returned
For health and hygiene reasons, sealed items such as underwear cannot be returned once they have been unsealed after delivery.
11. Your statutory rights
All Products are covered by your statutory rights under the Consumer Rights Act 2015, which apply regardless of anything in these Terms. Products must be:
- of satisfactory quality;
- fit for purpose;
- as described.
If a Product is faulty, you are entitled to the following remedies:
- Within 30 days of delivery: you can reject it and receive a full refund.
- After 30 days: you are entitled to a repair or replacement. If that is not possible or does not resolve the problem, you are entitled to a price reduction or a refund.
- Within six months of delivery: a fault is presumed to have been present at delivery, unless we can prove otherwise.
- Time limit for claims: you may have up to six years (five years in Scotland) from delivery to bring a claim.
For any query about these rights, please contact us at info@london-boutique.uk.
12. Intellectual property
All content on the Website is protected by intellectual property law and belongs to us or our partners. This includes text, images, layout, the "London Boutique" name and the logo. Any unauthorised copying or use is prohibited.
13. Use of the Website and our liability
The Website is provided "as is". We do our best to keep it available and working properly. However, we cannot guarantee uninterrupted or error-free access, for example during maintenance or because of events beyond our control.
We are not liable for loss or damage caused by use of the Website that breaches these Terms, or by events that are not our fault.
Nothing in these Terms limits or excludes our liability for:
- death or personal injury caused by our negligence;
- fraud;
- any liability that cannot be limited or excluded by law, including your statutory rights as a consumer.
14. External links and social media
The Website may contain links to third-party websites and social media platforms (Instagram, Facebook, TikTok). We have no control over these sites. We are not responsible for their content or for how they process your data.
15. Personal data and cookies
How we process your personal data is explained in full in our Privacy Policy, which is available on the Website. Please take the time to read it.
16. Events beyond our control
Neither party will be liable for failing to perform its obligations if the failure is caused by events beyond its reasonable control.
17. General
If any clause of these Terms is found to be invalid or unenforceable, the remaining clauses will remain in full force. If we do not enforce a right under these Terms straight away, we can still enforce it later.
18. Complaints and dispute resolution
If you have a problem, please contact our customer service team first at info@london-boutique.uk so we can try to resolve it amicably.
If your complaint is not resolved, you can get free, independent advice from Citizens Advice (www.citizensadvice.org.uk).
19. Governing law and jurisdiction
These Terms are governed by the law of England and Wales. You may bring proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in your local courts.
